Terms of Service

1.Who we are, and who this applies to

These terms are between you and Habitae Limited, a company registered in England and Wales (company number 17162166), registered office 24 Agamemnon Road, London NW6 1DY, trading as Verv (Verv, we, us). They apply whether you are a landlord listing a property, a tenant using the site to search, enquire or book a viewing, or anyone buying one of our paid services.

2.What Verv is

Verv is a platform connecting landlords and tenants directly, and a provider of paid property services including rent collection, tenant referencing, Right to Rent checks, inventories, accompanied viewings, photography and compliance certificates such as gas safety, EICR, EPC, PAT and fire risk assessment.

Where we provide these paid services, we are carrying out letting agency work, and we are a member of the Property Redress Scheme (PRS058729) and hold Client Money Protection through Client Money Protect (CMP015272).

3.Prices and VAT

All prices shown on Verv are in pounds sterling and include any VAT that applies, unless stated otherwise on the order page.

4.Your right to cancel (14 days)

If you are a consumer, you have 14 calendar days from the day after you place an order to cancel and receive a full refund, under the Consumer Contracts Regulations 2013. If you ask us to start a service, such as publishing your listing, before those 14 days are up, we will tell you in advance that this may mean you lose some or all of that right, and ask you to confirm you understand.

Full detail, including how appointment-based services work, is in our Cancellation Policy. Read that alongside this clause, since the two are meant to work together.

5.Paid services: what we do, and what you are responsible for

For any paid service that involves someone attending your property, such as a certificate, an inventory, a viewing or a photography visit, you are responsible for providing safe access at the time booked. If we cannot gain access through no fault of ours, we will try to rebook once free of charge; a further missed appointment may carry a charge, set out in our Cancellation Policy.

The person who attends may be our subcontractor rather than our direct employee, but we remain responsible to you for the service. Where a certificate identifies a fault, remedial work is not included in the certificate fee and will be quoted separately. A certificate is a record of the property's condition at the time of the visit, not an ongoing warranty of compliance.

Where you buy a Right to Rent check from us, that check does not transfer your statutory duty as a landlord, and does not give you a statutory excuse under the Immigration Act 2014 unless we have separately agreed in writing to act as your agent for that purpose.

6.Fees you cannot pass to a tenant

If you are a landlord, you must not charge a tenant or prospective tenant, or ask them to reimburse you, for viewing a property, applying for a tenancy, referencing, an inventory, or setting up a tenancy. Doing so may be a prohibited payment under the Tenant Fees Act 2019, or in Wales the Renting Homes (Fees etc.) (Wales) Act 2019, and we will not invoice a tenant directly for these services. They are sold to you, the landlord.

7.Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited or excluded by law. Nothing in these terms limits the statutory service quality rights you have under the Consumer Rights Act 2015.

Subject to that, our liability for any other loss is limited to the greater of £100 or the fees you have paid us in the 12 months before the claim arose, and we exclude liability for loss of rent or loss of profit if you are using our services for business purposes.

8.Changes to these terms

We will give at least 30 days' notice by email of any material change to these terms. If you do not want to accept the change, you can cancel any ongoing paid service without charge before it takes effect, and we will refund any fees paid for work not yet carried out.

9.Complaints

If something has gone wrong, contact us first at legal@verv.co.uk. We aim to acknowledge within 3 working days and give a written outcome within 15 working days.

If you are not satisfied, you can escalate free of charge to the Property Redress Scheme at theprs.co.uk, quoting our membership number PRS058729.

10.Governing law and jurisdiction

These terms are governed by the law of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of your home nation, and you keep the benefit of any mandatory consumer protections that apply there. Nothing here removes rights you have under the Consumer Rights Act 2015.

11.If you are a tenant

Creating an account, setting property alerts, enquiring about a listing or booking a viewing through Verv is free. These terms still apply to you, in particular the sections on liability, complaints and governing law, even where you have not bought a paid service.

Your use of the platform is also governed by our Privacy Policy, which sets out how your personal information is collected and used.
